Duration of Copyright

The lifespan of Copyright depends on the type of work protected:

 

50 years
after the death of the author for their literary, musical or artistic work

50 years
after the first publication of photograph or films

50 years
after the first performance of literary or musical work

50 years
after making of the sound recording

50 years
after the first broadcast

The following constitutes Copyright Infringement

A person who, at the time when Copyright subsists:

  • Makes for sale or hire; or
  • Sells or lets for hire; or
  • Imports into Seychelles otherwise than for his private and domestic use, an article which he knows to be an infringing copy of the work.


A person who, at the time when Copyright exists in a work, distributes, either:

  • For the purpose of trade; or
  • For other purposes, to such an extent as to effect prejudicially the owner of the Copyright, Articles which he knows to be infringing copies of the work.


A person who causes a literary or musical work to be performed in public, knowing that Copyright exists in the work and that the performance constitutes an infringement of the Copyright.
